These Terms and Conditions ("Agreement") govern the use of the products and services provided by Mimiquins ("we," "us," or "our"). By purchasing our made-to-measure mannequins ("Mimiquins") or using any of our services, you agree to be bound by this Agreement.
1. Definitions
- Mimiquin: A custom-made mannequin created based on a 3D scan of the customer’s body.
- Customer: The individual or business purchasing or using the services of Mimiquins.
2. Orders and Payment
- Order Confirmation: All orders for Mimiquins must be confirmed through our website or authorized sales channels. Full payment is required before the production of any Mimiquin begins.
- Payment Methods: We accept payments via BACS or credit card.
- Pricing: All prices listed are in GBP £ - Pound Sterling. Prices may be subject to change without notice but will not affect orders that have already been confirmed.
- Custom Orders: Since Mimiquins are made to measure and custom-fitted, once production has started, the order cannot be cancelled or refunded unless due to a defect or error on our part.
3. Production Process
- 3D Body Scanning: Customers must undergo a 3D body scan, which will be used to create a customized mannequin. The customer is responsible for confirming the scan is accurate at the time of ordering.
- Approval: After the scan, customers will be given an opportunity to review a virtual model of their Mimiquin before production. Any modifications must be requested during this stage.
- Production Time: Production typically takes around 10 weeks, depending on the complexity of the order. We will notify customers of any significant delays and reserve the right to extend the deadline due to internal or external circumstances.
4. Shipping and Delivery
- Shipping Costs: Shipping fees are included in the total price of the Mimiquin for UK Mainland only. Shipping fees for other locations are calculated based on the customer’s location and the size of the order. Customers are responsible for all shipping costs and import taxes unless otherwise stated.
- Delivery Times: Shipping and delivery times vary depending on the customer’s location. Estimated delivery dates will be provided once the order is confirmed.
- International Shipping: International orders may be subject to import duties, taxes, and other charges, which are the responsibility of the customer.
- Delivery Issues: If the customer is unavailable to receive the shipment, the customer is responsible for arranging re-delivery or collection.
5. Returns, Refunds, and Cancellations
- Non-Refundable: Due to the personalized nature of Mimiquins, all sales are final. We do not accept returns or offer refunds for custom-made mannequins unless they are defective.
- Defects: If the product arrives damaged or defective, the customer must notify us within 2 days of receipt to arrange for a replacement. Defects must be supported with clear photographic evidence. We may also request that the product be shipped back for inspection.
- Order Cancellation: Once production has started, cancellations are not permitted. If production has not yet begun, cancellations may be possible at our discretion, subject to a cancellation fee.
6. Product Care and Maintenance
- Care Instructions: Customers are responsible for the proper care of their Mimiquin. Mimiquins must be kept in a cool and dry space away from direct sunlight. When not in use, Mimiquins must be kept on the resting board provided by placing the middle hole on the stand.
- Repairs: In case of damage due to improper use, we might be able to offer repair services at an additional cost. Contact us for an estimate.
7. Warranty
- Warranty Coverage: Under the Consumer Rights Act 2015, all goods (including custom-made items) must meet the following conditions:
Satisfactory Quality: The product must not be faulty or damaged.
Fit for Purpose: The product must do what it's designed to do.
As Described: The product must match the description provided at the time of purchase.
Therefore, the warranty covers defects in materials such as faulty parts or weak stitching and workmanship defects, such as issues arising from poor craftsmanship during the creation of the product, such as assembly problems or mistakes made during manufacturing.
- What the Warranty Does Not Cover: The warranty does not cover damage caused by misuse, accidental damage, or modifications made by the customer.
- Since the product is made to the customer’s specifications, dissatisfaction with the design, fit, or style changes after the order has been placed is not covered.
- Damage caused by misuse, accidents, or improper care is excluded.
- Normal wear and tear, aging of materials, or degradation due to frequent use are not covered.
- Any modifications made to the product by the customer after purchase, such as adjustments or repairs done by third parties, will void the warranty.
8. Limitation of Liability
- General Liability: Mimiquins will not be held liable for any indirect, incidental, or consequential damages arising from the use of our products or services.
- Maximum Liability: Our maximum liability in any claim related to the purchase or use of a Mimiquin will not exceed the purchase price of the product.
9. Intellectual Property
- Ownership: All content, designs, and models provided by Mimiquins, including 3D scans and mannequin designs, are the intellectual property of Mimiquins and may not be reproduced, distributed, or used for commercial purposes without our express permission.
10. Privacy Policy
- Data Collection: We collect and store customer data, including body scans, solely for the purpose of fulfilling orders and providing services. We are committed to protecting customer privacy and ensuring that data is handled in compliance with applicable laws.
- Use of Data: Customer data will not be shared with third parties except for order fulfilment and delivery purposes.
- Retention of Data: We retain body scan data for 1 year to provide ongoing services, such as second Mimiquins of the same or different scales.
11. Changes to Terms and Conditions
We reserve the right to modify these Terms and Conditions at any time. Any changes will be posted on our website, and continued use of our services after such changes constitutes acceptance of the updated terms.
12. Governing Law
This Agreement is governed by the laws of the United Kingdom. Any disputes arising from this Agreement will be subject to the exclusive jurisdiction of the courts in the UK.
