Terms & Conditions

Mimiquins – Terms & Conditions

These Terms and Conditions (“Agreement”) govern the purchase and use of products and services provided by Mimiquins (“we”, “us”, or “our”).

By purchasing a custom-made mannequin (“Mimiquin”), digital avatar, or using any of our services, you agree to be bound by this Agreement.


1. Definitions

     Mimiquin: A custom-made mannequin produced using 3D body scanning technology.

     Digital Avatar: A 3D digital body model derived from the Customer’s body scan data.

     Customer: Any individual or business purchasing or using Mimiquins’ products or services.


2. Orders & Payment


2.1 Order Confirmation

All orders must be confirmed via our website or authorised sales channels. Full payment is required before production begins.


2.2 Payment Methods

We accept payment via BACS or credit card.


2.3 Pricing

All prices are listed in GBP (£). Prices may change without notice but will not affect confirmed orders.


2.4 Custom Orders

Due to the bespoke and made-to-measure nature of Mimiquins, once production has commenced, orders cannot be cancelled or refunded except in cases of verified defect or error on our part.


3. Production Process


3.1 3D Body Scanning

Customers must undergo a 3D body scan. The accuracy of the final product depends on the accuracy of the scan at the time it is taken.


3.2 Customer Responsibility

The Customer is responsible for ensuring correct posture and compliance during scanning and for reviewing any digital preview provided prior to production.


3.3 Body Changes

Mimiquins shall not be liable for changes in body shape, weight, posture, or measurements occurring after the scan date.


3.4 Production Time

Production typically takes approximately 12 weeks upon payment. Timelines may vary depending on complexity and operational factors. We reserve the right to extend production timelines due to internal or external circumstances.


4. Shipping & Delivery

Shipping is included for UK Mainland only. International shipping costs, import duties, taxes, and local charges are the responsibility of the Customer unless otherwise stated.

Delivery timelines are estimates and not guaranteed.

If the Customer is unavailable to receive delivery, re-delivery costs may apply.


5. Returns, Refunds & Cancellations

Due to the personalised nature of Mimiquins:

  • All sales are final upon receipt of initial payment, at which point production is deemed to have commenced and the order may no longer be cancelled. Refunds are only available in cases of verified defect. 
  • Production shall be deemed to commence upon receipt of initial payment, regardless of whether physical manufacturing has begun.
  • Defects must be reported within 2 days of receipt with photographic evidence.
  • Cancellations prior to production may be accepted at our discretion and may incur a      cancellation fee.


As Mimiquins are custom-made goods produced to the Customer’s specifications, the statutory 14-day cooling-off period under the Consumer Contracts Regulations 2013 does not apply once production has commenced.


6. Product Care & Maintenance


Customers must:

  • Store the Mimiquin in a cool, dry environment
  • Avoid direct sunlight
  • When not in use, the Mimiquin must be stored using the provided resting board,      with the central hole correctly positioned on the stand to ensure stable      support and to minimise long-term structural stress and gravity-related      strain. Damage caused by misuse may be repairable at additional cost.


7. Warranty


Under the Consumer Rights Act 2015, all goods (including custom-made items) must meet the following conditions:


       Satisfactory Quality: The product must not be faulty or damaged.

       Fit for Purpose: The product must do what it's designed to do.

       As Described: The product must match the description provided at the time of purchase.   

                                

Therefore, the warranty covers defects in materials such as faulty parts or weak stitching and workmanship defects, such as issues arising from poor craftsmanship during the creation of the product, such as assembly problems or mistakes made during manufacturing. 


What the Warranty Does Not Cover: The warranty does not cover damage caused by misuse, accidental damage, or modifications made by the customer.


Since the product is made to the customer’s specifications, dissatisfaction with the design, fit, or style changes after the order has been placed is not covered.


Damage caused by misuse, accidents, or improper care is excluded.


Normal wear and tear, aging of materials, or degradation due to frequent use are not covered.

Any modifications made to the product by the customer after purchase, such as adjustments or repairs done by third parties, will void the warranty.


8. Limitation of Liability


8.1 General

Mimiquins shall not be liable for indirect, incidental, or consequential damages.


8.2 Maximum Liability

Our total aggregate liability in respect of any claim shall not exceed the total amount paid by the Customer for the specific product or service giving rise to the claim.


8.3 Third-Party Software

We are not liable for compatibility or performance issues arising from third-party software or hardware used by the Customer, including CAD or garment design software such as Clos3D.

Mimiquins does not guarantee compatibility with any specific third-party software platform unless expressly stated in writing.


8.4 Scan Accuracy

The Customer acknowledges that final accuracy depends on scan conditions and body stability between scanning and production.


8.5 Non-Excludable Liability

Nothing excludes liability that cannot legally be excluded under applicable law.


9. Intellectual Property & Digital Files


9.1 Ownership

All intellectual property rights in and to all content, designs, and models provided by Mimiquins, including but not limited to 3D body scan data, digital avatar files (.obj or equivalent formats), digital and physical mannequin designs and models, and any underlying modelling processes, methodologies, or technical outputs, shall remain the exclusive property of Mimiquins.

Such materials may not be reproduced, modified, distributed, shared, reverse engineered, or used for commercial purposes without Mimiquins’ prior written consent.

No ownership or proprietary rights are transferred to the Customer under any circumstances.


9.2 Licence to Customer

Upon payment, the Customer receives a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to use digital avatar files strictly for personal, educational, or internal professional dressmaking purposes.

The Customer may not:

  • Resell or distribute files
  • Use files for competing services
  • Reverse engineer processes
  • Commercially exploit the files without written consent


9.3 Anonymity

Digital files supplied to Customers are anonymised and structured to remove direct identifying features. Once anonymised, such files may no longer constitute personal data within the meaning of applicable data protection legislation.


9.4 Educational, Website & Publication Use

Mimiquins may use anonymised digital files and derived visual representations for educational and informational purposes, including but not limited to:


           •  Books and printed publications
          • Digital publications and e-books
          • Online courses and tutorials
          • Workshops and masterclasses
          • Academic or professional presentations
          • Content published on the Mimiquins website
          • Social media content and educational posts


Such use shall be limited to educational and informational subjects, including:

           • Sewing techniques
          • Pattern drafting
          • Garment construction
          • Body proportions and fit analysis
          • Demonstrations of fit, structure, and garment development processes


All files used shall remain strictly anonymised. No identifiable facial features or personal identifying information shall be displayed without the Customer’s explicit written consent.

Customers may opt out of anonymised educational or informational use by notifying Mimiquins in writing. Upon receipt of such notice, Mimiquins shall use reasonable efforts to cease future use of the relevant files where possible. 


The Customer acknowledges that certain materials (including printed publications or distributed digital content) may not be capable of being withdrawn, amended, or unpublished once released. In all circumstances, any continued use shall remain strictly anonymised and may be further altered to prevent identification.


No compensation, royalty, or financial entitlement shall arise from such anonymised educational or informational use.


10. Data Protection & Privacy


10.1 Data Controller

Mimiquins acts as Data Controller under UK GDPR and EU GDPR.


10.2 Purpose of Processing

Data is processed solely for:

  • Production
  • Digital avatar creation
  • Customer support
  • Legal compliance


10.3 Data Retention

Scan data is retained for up to 1 year unless:

  • A repeat order is placed
  • Deletion is requested
  • Legal obligations require retention

Customers may request deletion at any time.


10.4 Intellectual Property Distinction

For the avoidance of doubt, data protection rights exercised by the Customer under applicable UK GDPR or EU GDPR legislation shall not affect or transfer any intellectual property rights owned by Mimiquins.


While Customers retain their rights in respect of their personal data, all intellectual property rights in the digital files, modelling outputs, derived designs, and technical processes remain the exclusive property of Mimiquins as set out in Clause 9.


Where a Customer exercises their right to erasure of personal data, Mimiquins shall delete or anonymise the relevant personal data where legally required. Such deletion shall not constitute a transfer of ownership of any intellectual property rights.


11. Force Majeure

Mimiquins shall not be liable for delays or failure to perform obligations due to events beyond reasonable control, including supply chain disruption, transport delays, material shortages, governmental action, or other force majeure events, and time for performance shall be extended accordingly.


12. Governing Law, Jurisdiction & Language


12.1 Governing Law

These Terms are governed by the laws of England and Wales.

If mandatory consumer laws in the Customer’s country of residence provide greater protection, those provisions shall apply.


12.2 Jurisdiction

The courts of England and Wales shall have exclusive jurisdiction.


12.3 Language

These Terms may be translated into other languages for convenience.

In the event of any discrepancy, the English version shall prevail and be legally binding.


13. Changes to These Terms

We reserve the right to update these Terms at any time. Continued use of our services constitutes acceptance of the updated Terms.

15. Agreement to Terms and Conditions

By making payment, you acknowledge and agree to the Terms and Conditions outlined on this website. Additionally, you confirm that you have read and understood the Learn More section (FAQs) provided on www.mimiquins.com.


16. Additional Provisions for EU Consumers

This section applies where the Customer is a consumer residing in a Member State of the European Union.


If any provision of these Terms conflicts with mandatory consumer protection laws of the Customer’s country of residence, such mandatory provisions shall prevail.


16.1 Right of Withdrawal (Cooling-Off Period)

Under EU consumer law, consumers purchasing goods at a distance generally have the right to withdraw from the contract within fourteen (14) days without giving any reason.

However, pursuant to Article 16(c) of Directive 2011/83/EU and corresponding national legislation (including the French Consumer Code), the right of withdrawal does not apply to goods made to the consumer’s specifications or clearly personalised.


As Mimiquins and Digital Avatars are custom-made products created from the Customer’s body scan data and produced according to the Customer’s individual measurements, they qualify as personalised goods.


Accordingly, once production has commenced, the right of withdrawal no longer applies.

Production is deemed to commence upon:

  • Receipt of payment; and
  • The Customer’s confirmation of scan approval.


By completing payment, the Customer expressly acknowledges and agrees that:

  • The order concerns personalised goods.
  • The statutory right of withdrawal will not apply once production has begun.


16.2 Pre-Contract Information

Prior to placing an order, EU consumers are provided with clear information regarding:

  • The main characteristics of the goods;
  • Total price including applicable VAT;
  • Delivery costs where applicable;
  • Estimated but not final import duties, taxes, and local charges, which are the responsibility of the Customer unless otherwise stated.
  • Estimated production timelines;
  • Payment arrangements;
  • Complaint handling procedures;
  • Identity and contact details of Mimiquins.


16.3 VAT & Cross-Border Sales

Where required under EU VAT regulations, VAT shall be applied according to the Customer’s country of residence under applicable distance selling rules.
